Virginia Abortion Amendment

On the ballot September 18 – November 3, 2026

From September 18th to November 3rd, 2026, Virginians will be voting on a constitutional amendment that would make abortion a “fundamental right” in our state. The amendment’s broad, vague language is one of the most extreme policies in the world, and would be devastating to pregnant, parenting, and preborn people in Virginia.

The amendment would:

Overturn parental consent, meaning minors could obtain abortions without parental permission or even notification
Overturn conscience protections for pro-life doctors, potentially forcing them to participate in abortion procedures
Allow for taxpayer funding of abortion, through all nine months of pregnancy
Legalize elective (non-medical) abortions past the point of viability
Prevent women from holding doctors and medical professionals accountable for medical malpractice
Prevent health and safety regulations from being enforced at abortion facilities
Fail to require that babies born alive during abortions receive medical care

Know before you go: the ballot question is designed to be deceptive and misleading! The language that voters will see in the ballot box does not reflect the true impact that this amendment will have on Virginia’s abortion law.

Virginia’s current abortion law already allows:

Abortion in the first two trimesters, with no restrictions
Abortion in the third trimester, with the agreement of three physicians
Abortion can be provided at any point in pregnancy in the case of a medical emergency

Virginia’s abortion law also includes:

Conscience protections for pro-life medical professionals
Parental consent requirements for minors to receive abortions
Requirements that life-saving care be provided to infants who are born alive in a failed abortion
